These Terms and Conditions ("Terms") govern your use of the services provided by Profitable Jobs, LLC ("Profitable Jobs," "we," "our," or "us"). By purchasing, accessing, or using any of our services, you agree to be bound by these Terms.

SMS Disclosure

These Terms apply to all SMS messages sent and received through the A2P 10DLC messaging services provided by Profitable Jobs, LLC.

By opting in, you agree to receive text messages related to account notifications, appointment reminders, marketing communications, authentication codes, customer support, and other service-related communications. Message frequency may vary.

Standard message and data rates may apply according to your mobile carrier.

You may opt out at any time by replying STOP to any message. For assistance, reply HELP.

Your consent to receive SMS messages is not a condition of purchasing any goods or services.

Messaging Delivery

Although we make every reasonable effort to deliver messages promptly, we cannot guarantee message delivery, timing, or availability. Delivery may be affected by mobile carriers, network outages, device compatibility, or other factors outside of our control.

Subscription Services

Most services offered by Profitable Jobs, LLC are provided on a recurring monthly subscription basis.

By purchasing a subscription, you authorize us to charge your selected payment method for the recurring fees associated with your selected services until your subscription is canceled.

Specific pricing, setup fees, included services, and billing schedules are presented during checkout or within your service agreement.

Subscriptions automatically renew each billing cycle unless canceled before the next renewal date.

Billing & Auto-Renewal

Subscription fees are billed in advance of each billing period using the payment method on file.

Unless canceled before your renewal date, your subscription will automatically renew and your payment method will be charged for the applicable subscription fees.

We reserve the right to modify pricing or available subscription offerings. Existing customers will receive reasonable notice before any pricing changes take effect.

Usage-Based Charges

Certain services rely on third-party communication providers and metered services.

Depending on the services you purchase, additional usage-based charges may apply, including but not limited to:

Phone numbers
SMS messaging
MMS messaging
Voice calls
AI usage
Number verification and intelligence services
Other communication-related services

Current usage rates are available within the platform, your account, or upon request.

Where applicable, clients maintain a prepaid wallet balance for these charges. If automatic wallet replenishment is enabled, your payment method may be charged based on your selected auto-top-up settings.

Refund Policy

Because our services involve immediate onboarding, software licensing, hosting, artificial intelligence services, automation setup, ongoing labor, and third-party costs, payments made to Profitable Jobs, LLC are generally non-refundable once work has begun or a billing period has started, except where required by applicable law.

Refund requests submitted after work has begun, accounts have been provisioned, or software licenses have been activated will generally not be approved.

Setup fees, subscription payments, and usage-based charges are generally non-refundable.

Cancellation Policy

You may cancel your subscription at any time.

Cancellation becomes effective at the end of your current billing period. Your subscription will not renew after cancellation.

Canceling your subscription does not entitle you to a refund for any unused portion of a prepaid billing period unless otherwise required by law.

Force Majeure

Profitable Jobs, LLC shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, cyberattacks, labor disputes, pandemics, or failures of third-party providers.

Limitation of Liability

To the fullest extent permitted by law, Profitable Jobs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability for any claim arising under these Terms shall not exceed the amount paid by the client to Profitable Jobs, LLC during the three (3) months immediately preceding the event giving rise to the claim.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

Client Responsibilities

Clients agree to provide timely access to any information, accounts, software, domains, hosting, Google Business Profile access, social media accounts, logos, written content, approvals, or other materials necessary for Profitable Jobs, LLC to perform the requested services.

Delays in providing requested materials may delay project completion or campaign performance and shall not be considered a failure on the part of Profitable Jobs, LLC.

Clients are responsible for maintaining accurate account information and ensuring payment methods remain current.

Delivery of Services

Services are considered delivered when the requested work has been substantially completed or made available to the client.

Services may include, but are not limited to:

Website completion
Platform setup
Automation deployment
CRM configuration
AI receptionist deployment
SEO implementation
Marketing campaign launch

Onboarding assistance, training, revisions, or support provided after delivery do not delay or alter service completion.

Marketing Results Disclaimer

Profitable Jobs, LLC uses industry best practices and proven marketing strategies; however, we cannot guarantee specific business outcomes.

We do not guarantee:

Search engine rankings
Google Maps rankings
Number of leads
Phone calls
Sales
Revenue
Return on investment
Business growth

Marketing performance depends on numerous factors outside of our control, including competition, market conditions, customer demand, client responsiveness, and third-party platforms.

Artificial Intelligence Services

Some services provided by Profitable Jobs, LLC utilize artificial intelligence to assist with customer communication, appointment scheduling, automation, lead qualification, content generation, and other business functions.

Although we strive for accuracy, AI-generated content, communications, recommendations, or responses may occasionally contain errors, omissions, or inaccurate information.

Clients remain responsible for reviewing AI-generated content where appropriate before publication or distribution.

Third-Party Services

Our services may rely upon third-party providers including, but not limited to:

Google
Stripe
OpenAI
LeadConnector
Meta
Domain registrars
Hosting providers
Telecommunications providers

Profitable Jobs, LLC is not responsible for outages, pricing changes, service interruptions, account suspensions, policy changes, or other issues caused by third-party providers.

Ownership

Clients retain ownership of any original business information, logos, trademarks, domain names, images, written content, and other materials they provide to Profitable Jobs, LLC.

Clients are responsible for maintaining backup copies of their own content and business assets. While Profitable Jobs may temporarily store certain materials to provide services, we are not responsible for maintaining permanent copies or restoring lost client data after services have ended.

Unless otherwise agreed in writing, the websites, hosting, CRM configurations, automation workflows, AI agents, templates, software, and other subscription-based services provided by Profitable Jobs, LLC are licensed for use during an active subscription and are not sold or transferred to the client.

Upon cancellation, access to subscription-based services may be suspended or terminated.

Any transfer, purchase, release, or assignment of website files, designs, source files, automations, CRM configurations, or other deliverables is solely at the discretion of Profitable Jobs, LLC and may be subject to additional fees or a separate written agreement.

Nothing in these Terms shall be interpreted as granting ownership of subscription-based services or proprietary technology through continued use or payment of subscription fees.

Proprietary software, templates, automation workflows, AI agents, CRM configurations, hosting environments, internal systems, and other technology developed, licensed, or maintained by Profitable Jobs, LLC remain the exclusive property of Profitable Jobs, LLC or its licensors unless otherwise agreed in writing.

Payment Failures & Service Suspension

If a scheduled payment cannot be processed, we may attempt to collect payment using the payment method on file.

We reserve the right to suspend or terminate services for overdue accounts until outstanding balances have been paid.

Profitable Jobs, LLC is not responsible for any interruption of services resulting from unpaid invoices or failed payments.

Billing Disputes

If you believe a billing error has occurred, please contact us promptly so we can investigate and resolve the matter.

If a chargeback or payment dispute is initiated, we reserve the right to suspend services while the dispute is being reviewed.

We may provide documentation demonstrating acceptance of these Terms, service usage, communications, invoices, and delivery records to the payment processor or financial institution in response to any dispute.

Fraudulent or abusive chargebacks may result in account termination and collection efforts where permitted by law.

User Obligations

You agree to use our services only for lawful purposes.

You may not use our services to transmit illegal, fraudulent, abusive, defamatory, harassing, or otherwise unlawful content.

You agree to comply with all applicable federal, state, local, and international laws relating to your use of our services.

Changes to These Terms

Profitable Jobs, LLC reserves the right to modify these Terms at any time.

Updated versions will be posted on our website. Continued use of our services after changes become effective constitutes acceptance of the revised Terms.
